Two players from the Netherlands won a lawsuit against Pokerstars and Bwin.

This is a ridiculous court ruling, and the question is, how the dutch court will enforce it, when pokerstars does not operate there? But it could put a spanner in the plans of PokerStars to aquire a dutch license, if they then have to compensate all dutch players, who lost money for 15 years. So all in all a stupid ruling, which is unfair and bad for online poker :(

InterSo, I have no complaint to PokerStars so far, I hope to remain at peace with them.

The lawyer claims that "The gambling companies have clearly ignored their duty of care."
If this truly is the case that they have done less than the regulated sites in that local jurisdiction, then maybe, but only maybe, I can understand this ruling.

Other than that it's a nightmare. But I'm confident that poker sites will continue to fight this in higher courts.

Both cases show that courts in the Netherlands are likely to side with plaintiffs in cases where gamblers who may have suffered gambling harm and can argue their case in court can claim particularly large amounts.

Yes i understood everything about it. Its not very difficult to understand if one can read. I can read. And apart from that i read other articles/threads about this topic some time ago.

I find the ruling ridiculous. With these guys have been just as willing to give back $1,000,000 in winnings if things had gone their way? Of course not. They played they accepted the terms and conditions and they knew what they were doing when they signed up. All this does is set up a bad precedent in my opinion and if I were any poker company I would never go into that country knowing that this type of lawsuit could be happening. Now yes if they have a license through that country they might be safe or would they? In today's world who knows.

There were no regulated sites in Netherlands during this time, because there was no law enabling companies to apply for a license. Netherlands was a "grey market", as all markets were in the early days of online gambling, and many still are. And if you read articles, where the lawyer of the plaintiffs are quoted, she is basically on a crusade against online gambling. Its about some people having gambling problems, and this being bad, which is of course true. But its difficult to see, what difference it makes to gambling problems, that there is a licensing system. So basically the lawyer and the plaintiffs are using the "grey" status of the dutch market during those years as an excuse to sue the gambling sites for something, which was really not their fault.
